These Terms of Service (“Terms”) govern your use of our website, academy.infozub.com and buy.infozub.com and learn.infozub.com (collectively called the “Site”), and the purchase and use of our courses provided in pre-recorded format.
By accessing or using the Site and purchasing our courses, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Site.
1. Use of the Site
Eligibility: You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this requirement.
License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and the courses for your personal, non-commercial use, subject to these Terms.
Prohibited Activities: You agree not to engage in any of the following prohibited activities:
- Using the Site or courses for any unlawful purpose.
- Attempting to interfere with or compromise the integrity or security of the Site.
- Accessing or using the Site to collect any market research for a competing business.
- Using any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Site.
- Transmitting spam, chain letters, or other unsolicited emails.
- Using the Site in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Site.
2. Account Registration
Account Creation: To access certain features of the Site, including purchasing and accessing courses, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Purchases and Payments
Pricing and Availability: All prices are displayed on the Site and are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice at any time.
Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
Refunds: Our refund policy allows for a full refund if requested within 7 days of purchase, provided you have not completed more than 20% of the course content. Please refer to our Refund Policy for more details.
4. Course Access and Use
License to Use: Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and view the purchased course content for your personal, non-commercial use.
Restrictions: You may not:
- Share your login credentials with others.
- Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the course content, except as permitted under these Terms.
- Use the course content for any commercial purpose.
5. Intellectual Property
Ownership: All content, features, and functionality on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Infozub Private Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Trademarks: Infozub Digital Academy and all related names, logos, product and service names, designs, and slogans are trademarks of Logesh Kumar or its affiliates or licensors. You must not use such marks without the prior written permission of Infozub Private Limited.
6. Disclaimers and Limitation of Liability
Disclaimer of Warranties: The Site and all content, products, and services available through the Site are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the fullest extent permitted by law, Infozub Digital Academy, its affiliates, or their licensors, service providers, employees, agents, officers, or directors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the courses, including but not limited to, loss of revenue, lost profits, loss of business, or loss of data, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
7. Indemnification
You agree to defend, indemnify, and hold harmless Infozub Private Limited, its affiliates, licensors, and service providers, and their respective officers, directors, employees and vendors.
8. Governing Law and Dispute Resolution
Governing Law: These Terms and your use of the Site shall be governed by and construed in accordance with the laws of INDIA / Tamil Nadu, without regard to its conflict of law principles.
Dispute Resolution: Any disputes arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the rules of the selected Arbitration Association/Organization, except that you may assert claims in small claims court if your claims qualify. The arbitration shall take place in Palladam, Tamil Nadu, in the Tamil / English language, and the arbitral decision may be enforced in any court.
Waiver of Jury Trial: You and Infozub Digital Academy waive any constitutional and statutory rights to go to court and have a trial in front of a judge or jury. You and Infozub Digital Academy are instead electing to have claims and disputes resolved by arbitration.
